Welcome to Designsuite.ai! This Terms of Use Agreement (the “Agreement”) is a legal contract between Designsuite.ai (referred to as “Designsuite” or “we”) and you, the client (“Client”). It covers your use of our website: https://bombe.design/ (the “Website”) and any related media, channels, or applications. By using our Website, you agree to these terms. If you do not agree, please stop using the Website immediately. This Agreement will remain in effect until you cease using the Website, except for any obligations you have to pay for services already rendered.

1. Intellectual Property Rights

The Website and all its content—including code, designs, audio, video, text, photos, and graphics (collectively, “Content”)—are owned by Designsuite and protected by copyright, trademark, and other intellectual property laws. All rights are reserved by Bombe.

2. Ownership of Materials

While Designsuite owns any feedback or submissions you provide, all design and original source files created for you (“Projects”) remain your property. You hold the copyright for all Projects. If, by law, Designsuite would otherwise own a Project, we will transfer all rights to you. You also confirm that any materials you provide to us do not infringe on any third-party rights. We may share your design work publicly unless otherwise agreed in Section 18.

3. Third-Party Fonts

If your Project includes fonts that require a commercial license (“Third-Party Fonts”), we will notify you. You will need to purchase licenses for these fonts to use the Project legally. We will provide information on how to obtain these licenses.

4. User Representations

By using the Website, you confirm that you:

• Have the legal capacity to agree to these Terms
• Are not a minor
• Will not use automated tools to access the Website
• Will use the Website only for lawful purposes
• Will not violate any applicable laws

5. Prohibited Activities

You agree not to:

• Use the Website for unauthorized purposes
• Create databases or directories from Website content
• Bypass security features
• Engage in unauthorized framing or linking
• Mislead or defraud
• Bombe or other users
• Disrupt or burden the Website
• Compete with Designsuite
• Reverse engineer or circumvent Website Software
• Harass Designsuite’s staff or agents
• Remove copyright notices
• Upload harmful software or interfere with Website functionality
• Disparage Designsuite or use the Website unlawfully

6. Client Feedback

Any feedback or submissions you provide become the property of Designsuite. We are not obligated to keep them confidential and may use them freely without compensation or permission.

7. Management and Oversight

Bombe reserves the right to monitor and manage the Website, including taking action against violations of these Terms. We may restrict or deny access to the Website at our discretion.

8. Privacy Policy

Your use of the Website means you agree to our Privacy Policy. The Website is hosted in India. By using the Website, you consent to the transfer and processing of your data in  India. We do not knowingly collect information from individuals under 18. If we learn that we have collected such information without parental consent, we will delete it.

9. Returns and Refunds

There are no refunds. We may take legal action for breaches related to refunds.

10. Modifications

We may change or remove any content on the Website at our discretion without notice. We also reserve the right to modify or discontinue the Website as needed.

11. Connection Interruptions

We do not guarantee that the Website will always be available. We are not liable for any issues or disruptions in service beyond our control.

12. Governing Law

These Terms are governed by the laws of India.

13. Litigation

Any legal action must be brought in the state courts of Kerala, India. You consent to this jurisdiction and waive any defenses related to venue and jurisdiction.

15. Limitations of Liability and Indemnification

Designsuite is not liable for any damages arising from your use of the Website. You agree to indemnify us against any claims related to your use of the Website or breach of these Terms.

16. User Data

You are responsible for any data related to your use of the Website. We are not liable for data loss or corruption.
